1. Acceptance of Terms
By accessing or using the Zumbu Africa platform ("Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Platform.
2. Platform Description
Zumbu Africa is an online marketplace connecting buyers and sellers across Africa. We provide the infrastructure for commerce but are not the seller of record for third-party listings.
3. User Accounts
You must be 18 years or older to create an account. You are responsible for maintaining the security of your account credentials and for all activity under your account. Notify us immediately of any unauthorised use.
4. Seller Obligations
Sellers must provide accurate product descriptions, pricing, and availability. Sellers are responsible for fulfilling orders, handling returns, and complying with all applicable laws including consumer protection legislation in their jurisdiction.
5. Buyer Obligations
Buyers agree to pay for purchases made and provide accurate delivery information. Fraudulent chargebacks or false claims may result in account suspension and legal action.
6. Prohibited Items
The following are prohibited on Zumbu Africa: counterfeit goods, illegal items, weapons, adult content, stolen property, hazardous materials, or any item that violates applicable law. Violation will result in immediate account termination.
7. Fees and Payments
Zumbu Africa charges a platform commission on completed sales. Commission rates are disclosed at the time of seller onboarding. Payment processing fees may apply depending on the payment method used.
8. Intellectual Property
All content on the Platform, including the Zumbu Africa brand, logo, and software, is owned by Zumbu Africa (Pty) Ltd. Sellers retain ownership of their product content but grant Zumbu Africa a licence to display it on the Platform.
9. Limitation of Liability
Zumbu Africa shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform. Our liability is limited to the amount of fees paid by you in the 12 months preceding the claim.
10. Governing Law
These Terms are governed by the laws of the Kingdom of Eswatini. Any disputes shall be resolved in the courts of Eswatini, unless otherwise required by applicable consumer law in your jurisdiction.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or a notice on the Platform. Continued use after the effective date constitutes acceptance of the updated Terms.
